第一章 总 则
Chapter I General Provisions
第一条 为规范国际学生签证管理，明确居留许可办理期限的确定依据，维护校区正常教育教学秩序及周边社区和谐稳定，根据《中华人民共和国出境入境管理法》、《中华人民共和国治安管理处罚法》等法律法规，《广东省高等学校招收和培养国际学生实施细则》（粤教外〔2021〕37号）、《哈尔滨工业大学研究生学籍管理规定》（哈工大研〔2022〕152号）、《哈尔滨工业大学本科生学籍管理规定》（哈工大本〔2025〕177号）、《哈尔滨工业大学深圳校区国际学生管理办法（试行）》（哈工大深国教〔2024〕9号）等规章制度，结合校区国际学生管理工作实际，制定本细则。
Article 1 These Implementation Rules are developed to regulate the international student visa management, clarify the basis for determining the residence permit extension period, ensure the smooth operation of education and teaching as well as the harmony and stability of surrounding communities, in accordance with relevant laws and regulations, including the Exit and Entry Administration Law of the People’s Republic of China, the Law of the People’s Republic of China on Administrative Penalty for Public Security, the Implementation Rules of Guangdong Province for the Recruitment and Cultivation of International Students by Higher Education Institutions, the Regulations for Management of Graduate Student Status of Harbin Institute of Technology, the Regulations for Management of Undergraduate Student Status of Harbin Institute of Technology, the Administrative Measures for International Students of Harbin Institute of Technology, Shenzhen (Trial), taking into account the specific context of international student management of Harbin Institute of Technology, Shenzhen (hereinafter referred to as HITSZ).
第二条 本细则适用于持外国护照在校区全日制注册学习的本科生、研究生。
Article 2 These Implementation Rules apply to undergraduate and graduate students who are registered with foreign passports for full-time study in HITSZ.
第三条 对学生的处理，应当坚持公平、公正、公开的原则，坚持教育与处分相结合的原则，坚持程序正当、证据充分、依据明确、定性准确、处分适当的原则。
Article 3 The handling of student disciplinary cases shall adhere to the principles of fairness, impartiality, and openness, the principle of combining education with disciplinary action, and the principles of due process, sufficient evidence, clear legal basis, accurate characterization, and appropriate sanction.
第四条 国际教育中心在协助办理居留许可延期时，依据本细则确定建议办理期限，并告知学生。最终审批结果以出入境管理部门决定为准。
Article 4 When assisting in residence permit extension, the International Education Center (hereinafter referred to as IEC) shall determine the recommended extension period in accordance with these Implementation Rules and inform the student accordingly. The final result shall be subject to the decision of the Immigration Office.
第二章 居留许可办理前提条件
Chapter II Prerequisites for Residence Permit Extension
第五条 国际教育中心在协助办理居留许可延期前，须确认以下条件：
Article 5 Before assisting in residence permit extension, IEC shall verify the following conditions:
（一）学生已缴清拟办理期限内全部学费。
(1) The student has paid full tuition fees for the intended extension period.
（二）学生已购买覆盖拟办理期限的保险。
(2) The student has purchased insurance that covers the intended extension period.
第六条 国际教育中心协助办理居留许可期限不得超过学生所在学历层次的最长修业年限，且居留许可有效期不得超出学生护照剩余有效期。学生因故无法在基本修业年限内完成学业的，须提前在教务系统中申请延长修业年限，获批后方可申请居留许可延期。
Article 6 A residence permit extension shall not exceed the maximum study period for the student’s degree level, the passport’s remaining validity. Students unable to complete their studies within the standard period for valid reasons must first apply through the academic affairs system for a study period extension. Only after such extension is approved may they apply for the residence permit extension.
第三章 考勤管理与延期期限
Chapter III Attendance Management and Extension Period
第七条 考勤分为课堂考勤和实验室考勤两类：
Article 7 Attendance is divided into two categories: classroom attendance and laboratory attendance:
（一）课堂考勤：适用于本科生与一年级硕士研究生，以国际学生管理系统中考勤数据为主要依据。
(1) Classroom attendance: Applicable to undergraduate students and first-year master’s students, based primarily on attendance data from the International Student Service System.
（二）实验室考勤：适用于博士研究生与二年级及以上硕士研究生，以导师反馈的月度考核结果为主要依据。
(2) Laboratory attendance: Applicable to doctoral students and second-year and above master’s students, based primarily on monthly evaluation result submitted by the supervisor.
第八条 本科生出勤情况与签证处置：
Article 8 Undergraduate student attendance and corresponding visa actions:
（一）学生出勤率达到80%及以上的，协助办理居留许可延期不超过一年。
(1) For students whose attendance rate is over 80%, HITSZ would assist in applying for a residence permit extension of no more than one year.
（二）学生出勤率在70%（含）至80%之间的，协助办理居留许可延期不超过六个月；最终是否签发及具体延期期限，由公安机关出入境管理部门根据实际情况决定。
(2) For students whose attendance rate falls between 70% (inclusive) and 80%, HITSZ would assist in applying for a residence permit extension for a period not exceeding six months. The final decision on whether to approve the extension and the specific duration thereof shall be determined by the Immigration Office.
第九条 研究生出勤情况与签证处置：
Article 9 Graduate student attendance and corresponding visa actions:
（一）硕士研究生实行分阶段考核：
(1) Master’s students are subject to a phased attendance assessment:
1. 第一学年（课堂考勤阶段）：
First academic year (classroom attendance phase):
（1）学生出勤率达到80%及以上的，参照第八条第一款执行；
(a) For students whose attendance rate is above 80%, the provisions of Article 8(1) shall apply;
（2）学生出勤率在70%（含）至80%之间的，参照第八条第二款执行。
(b) For students whose attendance rate is between 70% (inclusive) and 80%, the provisions of Article 8(2) shall apply.
2. 第二学年及以后（实验室考勤阶段）：
Second academic year and above (laboratory attendance phase):
导师反馈月度考核结果。若上一学年每月考核无不合格记录或不合格记录不超过两次的，协助办理居留许可延期不超过一年；若上一学年存在两次以上不合格记录的，学生须本人向导师提交书面说明。导师签字认定为“同意继续学习”的，国际教育中心依据导师意见协助办理居留许可延期不超过六个月；学生须接受后续跟踪考核。
The supervisor shall submit the monthly evaluation result. If there are no fail records in the monthly evaluation of the previous academic year, or if the number of fail records does not exceed two, HITSZ would assist in applying for a residence permit extension of no more than one year. If there are more than two fail records in the previous academic year, the student must submit a written explanation to the supervisor. If the supervisor signs and certifies that the student is “approved to continue studying”, HITSZ would assist in applying for a residence permit extension of no more than six months; the student shall be subject to subsequent follow-up evaluation.
（二）博士研究生出勤考核参照实验室考勤执行。
(2) Doctoral students’ attendance assessment shall be governed by the laboratory attendance provisions as set forth above.
第四章 违纪行为与延期期限
Chapter IV Disciplinary Violations and Extension Period
第十条 学生应遵守中国的法律法规和校区的各项规章制度，勤奋学习，文明守法。凡有下列行为之一（包括但不限于），经查证属实，属于违纪，构成违反签证管理规定的情形：
Article 10 Students shall abide by Chinese laws and regulations as well as all rules and regulations of HITSZ, study diligently, and behave in a civilized and law-abiding manner. Any of the following behaviors (including but not limited to), if verified to be true, shall constitute a disciplinary violation and shall be deemed as a circumstance of violating visa management regulations:
（一）在学生宿舍、居住社区、生活园区等居住场所内高声喧哗、聚众吵闹、发出嘈杂异响，制造不必要噪声，影响他人正常休息、睡眠作息及日常学习生活的。
(1) Shouting loudly, gathering and making noise, creating unnecessary and disruptive sounds in residential places such as student dormitories, residential communities, or living quarters, thereby affecting others’ normal rest, sleep schedules, and daily study or life.
（二）违反校区相关规定驾驶电动自行车、摩托车等车辆（如未按规定佩戴安全头盔、违规载人、违规充电等），引发他人投诉反映的。
(2) Violating HITSZ regulations on driving electric bicycles, motorcycles, or other vehicles (such as failing to wear a safety helmet as required, illegally carrying passengers, illegal charging, etc.), thereby causing complaints from others.
（三）因过量饮酒导致酒后言行失范，对校区声誉或公共秩序造成不良影响的。
(3) Engaging in improper conduct or speech due to excessive alcohol consumption, which adversely affects the university reputation or public order.
（四）在非指定场所开展宗教活动，传教、组织或非法参与宗教活动，或利用宗教干预、妨碍正常教学秩序的。
(4) Carrying out religious activities in non-designated places, proselytizing, organizing or illegally participating in religious activities, or using religion to interfere with or obstruct normal teaching order.
（五）无端生事，破坏公共秩序，在公共区域挑起冲突，干扰师生生活、校内经营及校区管理工作的正常运行。
(5) Engaging in unprovoked trouble, undermining normal order, instigating conflicts in public areas, and disrupting the daily lives of faculty and students, campus business operations, and the routine performance of various university administrative activities.
（六）因个人原因造成签证（或居留许可）超期、非法居留，或未经许可在华非法参与就业、实习，违反《中华人民共和国出境入境管理法》相关规定的。
(6) Causing the visa or residence permit to expire or resulting in illegal stay due to personal reasons, or engaging in illegal employment or internship in China without authorization, thereby violating relevant provisions of the Exit and Entry Administration Law of the People’s Republic of China.
（七）其他：虽未列入校区现行规章制度明确界定的违纪情形范畴，但经学部、国际教育中心调查评议认定具有不良影响、具有违规属性及弄虚作假情形，或存在其他违法违规、违背公序良俗、扰乱正常学习生活秩序以及被相关方有效投诉的。
(7) Other circumstances: Conduct that, although not explicitly defined as a disciplinary violation under the current rules and regulations of HITSZ, is determined by the College and IEC through investigation and review to have adverse effects, to be of a violation or fraudulent nature, or to involve other illegal or non-compliant acts, violations of public order or good customs, disruption of normal study and living order, or conduct that has led to valid complaints from relevant parties.
第十一条 对于事实明确，证据完整的违纪行为，国际教育中心直接出具居留许可延期期限告知书，并同时告知相关学部；对于学部认定违纪情形的，学部须将相关说明材料报送国际教育中心，国际教育中心依据学部提供的正式材料，向学生出具居留许可延期期限告知书。
Article 11 For disciplinary violations with clear facts and complete evidence, IEC shall directly issue a Notice of Residence Permit Extension Period and simultaneously inform the relevant College. For disciplinary violations determined by the College, the College shall submit the relevant explanatory materials to IEC, and IEC shall issue a Notice of Residence Permit Extension Period to the student based on the official materials provided by the College.
第十二条 对于违反第十条规定、违反校规校纪、扰乱社会秩序或违反治安管理规定的行为，经查证属实的，校区将依据《哈尔滨工业大学深圳校区学生违纪处分办法》，视情节轻重给予相应处理。有效投诉需提供完整证据，包括但不限于录音、视频、证人证言、物业或社区或公安机关的投诉记录等。
Article 12 For any conduct that violates the provisions of Article 10, violates HITSZ rules and regulations, disrupts social order, or contravenes public security administration regulations, if verified to be true, HITSZ shall impose corresponding sanctions according to the severity of the circumstances, in accordance with the Student Disciplinary Measures of Harbin Institute of Technology, Shenzhen. Valid complaints must be supported by complete evidence, including but not limited to audio recordings, video recordings, witness testimonies, and complaint records from property management, community authorities, or public security organs.
（一） 情节严重、影响恶劣，或经教育仍不改正的，被给予开除学籍处分的，国际教育中心配合注销其居留许可。
(1) If the circumstances are serious, the impact is severe, or the student fails to correct their behavior after being disciplined, leading to expulsion, IEC will assist in the cancellation of the student’s residence permit.
（二） 情节相对较轻，尚可给予改正机会的，其下次居留许可延期时，根据其学费缴纳情况及保险有效期，协助办理居留许可延期不超过六个月，作为考察期。
(2) If the circumstances are relatively minor and the student is still given an opportunity to correct the behavior, then upon the next residence permit renewal, IEC shall, based on the student’s tuition payment status and insurance validity period, assist in applying for a residence permit extension of no more than six months, which shall serve as a probationary period.
（三） 考察期内表现良好并已改正错误的，后续可按正常程序办理居留许可延期；考察期内仍无悔改表现或再次出现同类行为的，根据其学费缴纳情况及保险有效期，协助办理居留许可延期不超过三个月。
(3) If the student performs well during the probationary period and has successfully corrected the misconduct, subsequent residence permit extension may be processed in accordance with normal procedures. If the student shows no sign of repentance during the probationary period or commits a similar violation again, IEC shall, based on the student’s tuition payment status and insurance validity period, assist in applying for a residence permit extension of no more than three months.
第五章 学生义务
Chapter V Student Obligations
第十三条 居留许可办理中的学生义务：
Article 13 Student obligations in residence permit application:
（一）学生在办理居留许可过程中，须保持联系电话畅通。因联系不畅导致出入境管理部门无法核实信息的，校区可暂停协助办理。
(1) During the residence permit extension process, the student must keep their contact telephone number accessible. If the Immigration Office is unable to verify information due to the student being unreachable, the university may suspend its assistance in the application process.
（二）出入境管理部门有权要求申请人补充材料，并通过电话询问、面谈、实地调查等方式核实信息。学生须积极配合。不予配合或经核查不符合条件的，校区不予出具居留许可延期相关材料。
(2) The Immigration Office has the right to request supplementary materials from the applicant and to verify information through telephone inquiries, interviews, on-site inspections, or other means. The student must fully cooperate. If the student fails to cooperate or does not meet the requirements after verification, the university shall not issue any documents for residence permit extension.
（三）因学生个人原因导致居留许可延期申请被撤销或不予受理的，由学生本人承担相应后果。
(3) If the residence permit extension application is withdrawn or rejected due to personal reasons attributable to the student, the student shall bear the corresponding consequences.
第十四条 取得居留许可后的学生义务：
Article 14 Student obligations after obtaining a residence permit:
（一）学生取得新居留许可后，须及时向住所地公安机关更新临时住宿登记信息，同时登录国际学生管理平台，更新居留许可信息。
(1) After obtaining a new residence permit, the student must promptly update their Registration Form of Temporary Residence for Visitors with the public security authority at the place of their residence, and update the new residence permit information in the International Student Service System.
（二）有下列情形之一的，学生须及时重新办理临时住宿登记：
1. 变更住址的；
2. 更换护照的；
3. 更换签证或居留许可的；
4. 临时住宿登记到期的。
未按规定重新登记的，按非法居留处理，相关法律后果由学生本人承担。
(2) Under any of the following circumstances, the student must promptly re-apply for Registration Form of Temporary Residence for Visitors:
(a) Changing their address of residence;
(b) Renewing their passport;
(c) Changing their visa or residence permit;
(d) Expiration of the Registration Form of Temporary Residence for Visitors.
Failure to re-apply as required shall be treated as illegal stay, and the relevant legal consequences shall be borne by the student themselves.
第十五条 离校情形与停留签证：
Article 15 Circumstances of leaving the university and Stay Permit:
学生因休学、退学、毕业、结业或被开除学籍等原因终止在校学习的，须在审批通过之日起，本科生七日内、研究生十日内，持相关证明文件前往出入境管理部门申办停留签证（有效期最长三十天）。
When a student’s enrollment is terminated due to suspension, withdrawal, graduation, completion of study, or expulsion, they must apply for a Stay Permit (maximum validity of 30 days) from the Immigration Office.Within 7 days for undergraduate students, or within 10 days for graduate students, from the date of approval, the Stay Permit application with relevant supporting documents shall be submitted.
逾期未办理停留签证的，校区将向出入境管理部门申请注销其居留许可，由此产生的一切后果由学生本人承担。
If the student fails to apply for a Stay Permit within the prescribed time limit, the university shall apply to the Immigration Office for cancellation of the student’s residence permit, and all consequences arising therefrom shall be borne by the student themselves.
第六章 附 则
Chapter VI Supplementary Provisions
第十六条 本细则自发布之日起实施。
Article 16 These Implementation Rules shall take effect as of the date of issuance.
第十七条 本细则由国际教育中心负责解释。未尽事宜，按照国家相关法律法规及校区相关管理规定执行。
Article 17 IEC shall be responsible for the interpretation of these Implementation Rules. Matters not covered herein shall be handled in accordance with relevant national laws and regulations and the applicable management rules of HITSZ.
